Sikap Ikatan Wartawan Online (IWO) terhadap Pernyataan Kadiv Humas Mabes Polri

Jakarta — DPP Ikatan Wartawan Online (IWO) Indonesia dengan ini mengeluarkan sikap sangat menyayangkan atas pernyataan Mabes Polri dalam menangani kasus sengketa pers yang melibatkan dua jurnalis di Medan yakni saudara Jon Roi Tua Purba dan Lindung Silaban yang dituding mencemarkan nama baik Kapolda Sumut, Irjen Pol Paulus Waterpauw lewat penulisan berita.

Pernyataan Kadiv Humas Polri Irjen Pol Setyo Wasisto yang di kutip dari pemberitaan Tribunnew.com tersebut meminta agar kedua jurnalis tersebut diperiksa, apakah memiliki sertifikasi atau tidak, dinilai Ikatan Wartawan Online Indonesia sangatlah keliru dan tidak memiliki dasar hukum yang jelas.

Menurut Wasito, jika kedua wartawan tersebut memiliki sertifikasi wartawan maka kasus tersebut diserahkan ke Dewan Pers, tapi kalau tidak (bersertifikasi), Dewan Pers akan menolak. Berarti kedua jurnalis yang jadi tersangka sama dengan masyarakat yang lain. (Bisa digunakan pasal pidana pencemaran nama baik).

Atas pernyataan Kadiv Humas Polri tersebut maka kami IWo menilai bahwa pernyataan Irjen Pol Setyo Wasisto tersebut jelas-jelas telah mencederai kemerdekaan pers yang telah dijamin oleh Undang-Undang Pers No. 40 tahun 1999.

Kami pun sepakat dengan beberapa Organisasi Pers yang juga telah menyatakan sikapnya terkait hal ini bahwa dalam penyelesaian kasus ini seharusnya Polri menggunakan ketentuan hukum yang diatur dalam pasal-pasal di UU Pers, bukan dengan ketentuan hukum di luar itu.

Karena sertifikasi yang dilakukan Dewan Pers tidak bisa dijadikan dasar hukum dalam penegakan hukum di kepolisian.

Terlebih produk sertifikasi yang dilakukan Dewan Pers sangat bertentangan dengan UU No. 13 Tahun 2003 tentang Ketenagaakerjaan yang telah mengatur secara jelas mengenai uji kompetensi yang merupakan kewenangan Badan Nasional Sertifikasi Profesi dan bukan Dewan Pers.

Pada pasal 18 ayat (4) disebutkan: “untuk melaksanakan sertifikasi kompetensi kerja dibentuk badan nasional sertifikasi profesi yang independen.”

“Jadi sertifikasi wartawan produk Dewan Pers, selain bertentangan dengan Undang-Undang Ketenagakerjaan juga bukan produk hukum yang bisa dijadikan dasar menentukan seseorang merupakan wartawan atau bukan.”

Oleh karena itulah kami dari Ikatan Wartawan Online (IWO) Indonesia juga berpendapat seharusnya Polri dapat menangani kasus sengketa pers dengan tetap mengacu pada pasal 1 ayat (11) : “Hak Jawab adalah hak seseorang atau sekelompok orang untuk memberikan tanggapan atau sanggahan terhadap pemberitaan berupa fakta yang merugikan nama baiknya.” dan ayat (12): “Hak Koreksi adalah hak setiap orang untuk mengoreksi atau membetulkan kekeliruan informasi yang diberikan oleh pers, baik tentang dirinya maupun tentang orang lain.” Dan yang terpenting adalah pasal 1 ayat (13) yakni : “Kewajiban Koreksi adalah keharusan melakukan koreksi atau ralat terhadap suatu informasi, data, fakta, opini, atau gambar yang tidak benar yang telah diberitakan oleh pers yang bersangkutan.”

Pasal inilah yang harus digunakan Polri dalam menangani kasus tersebut.

Demikian surat pernyataan ini kami buat sebagai bagian dari tanggungjawab kami selaku organisasi pers agar dunia pers dan para pemangku kepentingan berjalan di jalur yang benar.
