IWO: Politik Hukum Pemerintah Belum Berpihak Kepada Kemerdekaan Pers

Jakarta — Ahli hukum Pers Dr. Ibnu Mazjah,SH, MH menilai bahwa Undang-Undang No.40 Tahun 1999 tentang pers tidak bersifat lex specialis atau hukum yang bersifat khusus dari Kitab Undang-undang Hukum Pidana (KUHP). Hal ini disebabkan UU No.40 tahun 1999 tidak ada ketentuan yang mengatur perbuatan pidana berhubungan dengan pelaksanaan fungsi pers yang merupakan Pasal padanan dari KUHP.

“Undang-Undang Pers lebih tepat disebut sebagai UU administrasi yang didalamnya terdapat ketentuan pidana atau administratif penal law,” ucap Ibnu dalam keterangannya, Jakarta, Rabu (18/4/2018).

Lanjut dia, ketentuan administrasi dalam UU Pers, bertalian dengan syarat bagi perusahaan pers nasional yang harus berkedudukan sebagai badan hukum. Sedangkan ketentuan pidana yang diatur di dalam UU a quo sama sekali tidak ada hubungannya dengan pasal-pasal di dalam KUHP yang kerap dijadikan sarana untuk menjerat insan pers dalam melaksanakan tugasnya.

“Selain itu berkaitan dengan pertanggungjawaban terhadap produk Pers Nasional, UU Pers juga tidak memiliki pandangan yang tegas siapa yang harus dibebankan pertanggungjawaban,” kata dia. Ujung-ujungnya, kata dia, yang digunakan adalah UU KUHP, atau yang kini sedang ngetrend adalan UU ITE bagi insan pers dari media online.

Dosen Pascasarjana Universitas, Mathlaul Anwar Banten itu menekankan, di dalam Pasal 12 terdapat frasa “penanggungjawab”. Semestinya, sesuai dengan doktrin pertanggungjawaban badan hukum penanggungjawab adalah pihak yang seharusnya dibebankan pertanggungjawaban. Namun ketentuan itu menjadi ambigu dan tidak berkepastian hukum disebabkan di dalam penjelasan Pasal 12 disebutkan “sepanjang menyangkut ketentuan pidana mengikuti peraturan perundang-undangan”.

Dengan frasa “perundang-undangan” maka berdasarkan sistematika hukum, insan pers tetap didudukkan sebagai subjek hukum alami (recht persoon). Hal ini pada berakibat, bila terjadi perbuatan Pidana dalam melaksanakan fungsi pers, insan pers bisa dijerat dengan UU pidana lain di luar UU Pers itu sendiri, seperti UU ITE.

“Terutama wartawan media online, bilamana dalam pelaksanaan fungsi pers melakukan suatu perbuatan yang dianggap memenuhi rumusan delik di dalam UU No. 19/2016 tentang ITE, akan sangat mudah penegak hukum menjerat dengan UU tersebut,” papar dia.

Sebelumnya saat pelatihan Jurnalistik dan Sosialisasi Perlindungan Hukum Bagi Wartawan di Batiqa Hotel Jababeka, Cikarang, Bekasi, Jawa Barat, pada Selasa 17 April 2018, Ibnu menekankan bahwa politik hukum pemerintah belum berpihak kepada kalangan insan pers.

“Untuk itu, Ikatan Wartawan Online (IWO) sebaiknya menginisiasi agar Pemerintah dan DPR segera melakukan revisi UU Pers yang berkepastian hukum dengan menjadikan UU Pers sebagai Lex spesialis dalam menjerat kalangan pers dari kalangan industri pers nasional,” tutur dia.

Ibnu yang juga Ketua Bidang Hukum dan Advokasi PP IWO itu menambahkan bahwa Lex specialis dapat dirumuskan dengan menjadikan sarana pidana sebagai alat terakhir (ultimum remedium).

“Caranya dengan mengedepankan penyelesaian melalui sarana restoratif justice dan mengedepankan etika profesi. Sehingga para pekerja pers yg beritikad baik tidak berada dalam bayang-bayang ancaman pidana,” demikian Ibnu. (IWO)
